It is the buyer’s solicitors responsibility to investigate the title of the property and undertake searches when acting for the buyer in a transaction.
Caveat emptor is the principle that the buyer must ‘beware’ i.e. he is responsible for ensuring he is purchasing what was contracted. So to do this, the buyer’s solicitor will investigate in depth.
