I started my second seat which is Dispute Resolution & Employment. There have been many lessons learnt and I’m sure this will continue. The type of work I have been involved in varies - Landlord and Tenant issues, debt claims, contentious probates, mediation, court proceedings, dilapidations. It’s really interesting getting an insight into the variety of work.
My starting point was the Civil Procedure Rules (CPR) - Pre-Action Protocols. There are some specific protocols such as Housing Conditions Claims, Dilapidations Protocol, Personal Negligence. As this variety of different protocols are all new to me, I have been doing a lot of legal research, familiarising myself with the various new matters and calls to courts (damn the waiting time is looong!!)
On the Employment side, we have had some settlement agreements, drafting employment contracts, employment issues. I have been involved more on the disputes side of things for now!
Some of the tasks I have been involved in:
Creating a disclosure schedule with a chronology of events and identifying the issues in the case
Drafting Claim forms and serving them at court and on the other parties
Drafting forms for submission at Land Registry where there are properties involved
Preparing mediation bundle of full disclosure of the documents to be sent to Counsel and the other side
Attending client meetings and taking minutes
Some days I feel like a total idiot with the questions I ask and errors made (corrections followed…) but at the end of that week I try to remind myself that I’m on a long learning process and a new week will follow with new opportunities!
