A lot more DR and employment experience under the belt! It's been busy with some interesting new instructions. Some of the tasks that have kept me busy:
Drafting Instructions to Counsel - we're acting in a matter of constructive dismissal case. Our client required Counsel advice whether there are prospects of success if they went ahead with resigning. In order to obtain Counsel's advice, the instructing solicitors draft a brief to Counsel, summarising the chronology of events and attach relevant evidence. This is a good exercise to be able to concisely and accurately explain the matter to someone else i.e. Counsel. Upon receipt, Counsel will advice either in writing or in conference or both!
Directions questionnaire - having filled out the claim form and particulars of claim for a client, we're moving onto hearings! By the specific deadline set by the court (it was Good Friday, how wonderful!) solicitors for claimants and defendants must file Directions Questionnaire outlining which track they suggest the claim should be allocated to based on the facts, the money being claimed and complexity. As we suggested it was multi-track, you must file a Precedent H (huge spreadsheet listing costs at different stages of the claim). Based on this info, a judge will allocate to small, fast or multi-track. The court then confirms the track and a costs and case management conference (CCMC) may be set.
Employment - some more employment contracts for different level employees such as Directors or administration employees. More settlement agreements where employees have been made redundant and they require independent legal advice to ensure the agreement the right amount of redundancy pay is being paid and the employee will not go to an employment tribunal.
I have been involved in a few more property litigation matters, possession proceedings, non-payment of rent - relatable and useful variety of work!
